1.– PROMOTION ORGANIZING COMPANY
CB Charm Market with address in Tres Cantos – Madrid, organizes the draw (hereinafter, “the Promotion”) of national scope, to be developed through the Internet (Instagram), exclusively for users residing in Spain in accordance with the provisions of the participation requirements section.
The purpose of this draw is to reward the loyalty of the brand's followers, with 2 gift vouchers worth €50 each, to be used in the edition of May 26, 27 and 28, 2023.
2.- START DATE AND END DATE
The Promotion will start on May 17, 2023 at 6:00 p.m., and will end on May 25, 2023 at 10:00 p.m.
The Company reserves the right not to proceed with the promotional action if by the stated start date there has not been more than 200 participants.
3.- PARTICIPATION REQUIREMENTS AND PROMOTION MECHANICS
The participation requirements will be the following:
- Those people who reside in Spain and
are over 18 years of age. - Only those Participants who are account holders may participate.
on Instagram. - Participants must follow the brand and comment on the post by tagging 2 friends during the participation period.
- Participants may participate as many times as they wish, always mentioning 2 different people. The more people you mention, the more chances you have of winning.
4.- PROMOTION CONDITIONS AND PRIZES
It will be chosen 2 winners through the random draw platform. The winner will be announced on the 25th at 10:30 p.m. through the brand's social profiles.
The prize will consist of 2 gift vouchers of €50, one for each winner. The delivery will be made to the winner in person and with a supporting document at the event held on the days 26, 27 and 28 May at the Santa Bárbara Palace, Calle de Hortaleza, 87 #Madrid . The prize cannot be exchanged for cash. SIt will only be valid for the edition of the 26th, 27th and 28th May at the Santa Bárbara Palace, Madrid. The Company reserves the right to modify the prize if there are problems with the cancellation of the event on the day the participant is declared the winner. The winner may contact the Company within a period of 2 days from the date on which the winner is announced on the brand's social profile. If such contact is not made within the stipulated period, the draw will be declared void or another winner will be assigned. The holding of the draw, as well as the awarding of the prize, are subject to current tax regulations.
5.- DISQUALIFICATIONS AND PENALTIES
If it is found that any of the Participants do not meet the requirements set out in the Rules, or the data provided to participate are not valid, their participation will be considered void and they will be automatically excluded from the Promotion, losing all rights to the prizes awarded under this Promotion.
The Company reserves the right to declare the draw void.
6.- PUBLICATION OF COMMENTS OR OPINIONS
Comments or opinions whose content is considered inappropriate, offensive, insulting or discriminatory or that could violate the rights of third parties will not be permitted. Comments against an individual that violate the principles of the right to honor, personal and family privacy and one's own image will also not be permitted.
We will not be liable for any damages caused by comments made by Participants in the Promotion, which at any time could hurt the sensibilities of other Participants.
Participation in this Promotion, as well as the publication of comments made by Participants in the posts, may not under any circumstances violate the Instagram Community Rules or the Instagram Terms of Use. If the Company is found to be using fraudulent means to participate, such as the use of bots in the comments, the prize will not be awarded and will remain the property of the Company.
7.- EXONERATION OF LIABILITY
By way of example, but not limited to, we are not responsible for any possible losses, thefts, delays or any other circumstance attributable to third parties that may affect the development of this Promotion, nor are we responsible for the use made by the Participant of the prize obtained from this Promotion. We do not assume responsibility in cases of force majeure or fortuitous events that may prevent the Promotion from being carried out or the total or partial enjoyment of the prize. In the event that this Promotion cannot be carried out, either due to fraud detected in it, technical errors, or any other reason that is not under the control of the Company and that affects the normal development of the Contest, we reserve the right to cancel, modify, or suspend it, including the participation website.
8.- PROTECTION OF PERSONAL DATA
The company responsible for the processing of your data is Mercado del Encanto CB . In accordance with the provisions of the General Data Protection Regulation, each participant, by accepting these Legal Bases, consents to their personal data being incorporated into a file, owned by this company, for the purpose of managing the draw, as well as disseminating and publicizing its results, and processing the delivery of the prize. We inform you that you can exercise your rights of Access, Rectification, Deletion, Opposition, Limitation of processing, Portability, forgetting and not being subject to automated individual decisions by sending an email to mercadodelencanto@gmail.com
Without prejudice to any other administrative remedy or legal action, the Participant shall have the right to lodge a complaint with a Supervisory Authority, in particular in the Member State in which he or she has his or her habitual residence, place of work or place of the alleged infringement, if he or she considers that the processing of his or her personal data is not appropriate to the regulations, as well as in the event that he or she is not satisfied with the exercise of his or her rights.
For this reason, the Participant declares to have been informed of the conditions regarding the protection of personal data, accepting and consenting to the processing.
9.- CHANGES AND ACCEPTANCE
We reserve the right to modify or expand these promotional rules, provided that this does not harm or undermine the rights of the Participants in the Promotion.
The mere fact of participating in the draw implies that the Participant fully accepts the conditions of these Legal Bases. Likewise, participation in a draw of this nature implies acceptance of the rules of the Instagram social network through which it is developed.
10.- APPLICABLE LEGISLATION AND JURISDICTION
These legal bases will be governed in accordance with the law of Spain. The Courts and Tribunals of the city of residence of the Participant will be competent to resolve any claim or dispute that may arise in relation to the validity, interpretation or compliance with these bases.
